Terms and conditions

These Terms and Conditions ("Terms") govern access to and use of Learnest, including trylearnest.com, the Learnest web application, and the Learnest mobile apps for iOS and Android (together, the "Service"). References to "Learnest", "we", "us", or "our" mean Aritra Sarkar, the operator of the Service. By creating an account or otherwise using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

If you are using the Service on behalf of a school, coaching institute, or other organisation (an "Institution"), you are representing that you have the authority to bind that Institution to these Terms, and "you" refers to both you and the Institution.

1. Definitions

  • Account — a Learnest profile registered as a teacher, a student, or an administrator of an Institution.
  • Content — any question, exam, answer, note, file, image, or other material a user uploads to, or generates through, the Service.
  • Classroom — a group created by a teacher that students join, typically by scanning an invite QR code.
  • Wallet Credits — the pay-as-you-go balance used to pay for AI-assisted features such as exam and question generation.
  • Attempt — a single run by a student through a scheduled exam.

2. Eligibility and accounts

You must be able to form a legally binding contract to create an Account. If you are under 18, you may use the Service only with the consent and supervision of a parent, legal guardian, or an Institution that has enrolled you and accepted these Terms on your behalf — for example, a student who joins a Classroom created by their school. The Service does not currently perform automated age verification at signup; by creating an Account you are representing that you meet this requirement, or that a parent, guardian, or Institution has authorised your use.

You are responsible for the accuracy of the information on your Account and for all activity that happens under it. Tell us promptly at [email protected] if you believe your Account has been accessed without authorisation.

3. The Service

Learnest lets teachers build question banks and exams — with the help of AI where they choose to use it — organise students into Classrooms, schedule timed exam runs, and review results. Students join a Classroom, take scheduled exams through the Learnest mobile app, and see their results and marking once an exam closes. Not every feature is available on every platform, and we may add, change, or remove features as the Service evolves.

4. Your Content

You keep ownership of the Content you create or upload. By submitting Content to the Service, you grant Learnest a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, and process that Content solely to operate and improve the Service for you — for example, to display a question bank back to its author, run it through an AI model at your request, or include an answer script in a marking workflow. This licence ends when you delete the Content or close your Account, except where a copy needs to persist for a period for backup, legal, or dispute- resolution purposes.

You are responsible for the Content you submit and for having the rights to submit it. Do not upload Content that infringes someone else's rights, contains malware, or violates applicable law.

5. AI-generated content

Some features generate questions, answers, explanations, or marking suggestions using third-party AI models. AI output can be incomplete, out of date, or wrong — including getting a fact, calculation, or marking judgement wrong with apparent confidence. Learnest does not guarantee the accuracy, completeness, or fitness for any purpose of AI-generated Content. A teacher publishing an AI-drafted exam, or relying on AI-assisted marking, is responsible for reviewing it before it reaches students or affects a result.

6. Acceptable use

You agree not to:

  • Use the Service to cheat on, or help someone else cheat on, an exam administered outside Learnest;
  • Circumvent, disable, or interfere with the exam-integrity safeguards described in Section 7;
  • Access another user's Account, Classroom, or exam Attempt without authorisation;
  • Scrape, reverse-engineer, or use automated means to extract Content or data from the Service, other than through an API we publish for that purpose;
  • Upload Content that is unlawful, harassing, or infringes a third party's intellectual property or privacy;
  • Impersonate another person or misrepresent your affiliation with an Institution; or
  • Probe, scan, or attempt to defeat the security of the Service.

7. Exam integrity and "proctored" runs

A "proctored" exam on Learnest is administered through the Learnest mobile app with integrity safeguards built into the app — for example, detecting when the app loses focus during a timed Attempt, continuing an Attempt through a loss of connectivity, and recording integrity events for the teacher to review. Proctoring on Learnest does not involve webcam, microphone, or biometric monitoring of any kind. A teacher may act on a recorded integrity event — including invalidating an Attempt — as part of running their exam; Learnest is not a party to that academic decision.

8. Fees, wallet credits, and subscriptions

AI-assisted features are paid for from a Wallet Credits balance that you top up in advance. Wallet Credits are non-refundable once credited to your Account, including if they go unused, except where required by applicable law.

Learnest Pro is billed on a recurring basis by auto-debit through our payment processor. You can cancel Pro at any time from your account settings; cancellation stops future billing but does not refund the period already paid for. Prices are shown in the currency displayed at checkout and may include applicable taxes. We may change our fees; changes to a recurring subscription take effect from your next billing cycle, and we will give you reasonable notice beforehand.

Payments are processed by Razorpay. Learnest does not receive or store your full card, UPI, or bank account details — see our Privacy Policy for how payment data is handled.

9. Third-party services

The Service is built on third-party infrastructure, including Firebase (authentication), Razorpay (payments), Anthropic and OpenAI (AI processing), and Cloudflare (file storage). Your use of the Service is also subject to the applicable terms of these providers where they interact directly with you, such as signing in with a Google account.

10. Intellectual property

The Learnest name, logo, and the Service's software, design, and underlying technology are owned by Learnest or its licensors and are protected by intellectual property law. Nothing in these Terms transfers any of that to you, beyond the limited right to use the Service as intended.

11. Suspension and termination

You may stop using the Service and close your Account at any time. We may suspend or terminate an Account that breaches these Terms, poses a security risk, or is used to compromise exam integrity, with notice where practicable. Sections of these Terms that by their nature should survive termination — including Sections 4 (as to retained copies), 10, 13, 14, 15, and 16 — will survive.

12. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including any warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of AI-generated inaccuracies described in Section 5.

13. Limitation of liability

To the maximum extent permitted by law, Learnest will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, or academic outcome, arising from your use of the Service. Learnest's total liability for any claim arising out of these Terms will not exceed the amount you paid to Learnest in the twelve months before the claim arose.

14. Indemnification

You agree to indemnify and hold Learnest harmless from any claim, liability, or expense (including reasonable legal fees) arising from your Content, your breach of these Terms, or your violation of any law or third-party right.

15. Governing law and dispute resolution

These Terms are governed by the laws of India. Subject to applicable law, the courts at Kolkata, West Bengal have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service.

16. Grievance officer

In accordance with applicable Indian law, complaints or concerns about the Service can be directed to our grievance officer at [email protected]. We will acknowledge your complaint and aim to resolve it within a reasonable time.

17. Changes to these Terms

We may update these Terms from time to time. If a change is material, we will give reasonable notice — for example, by email or an in-app notice — before it takes effect. Continuing to use the Service after a change takes effect means you accept the updated Terms.

18. General

If any provision of these Terms is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with the Privacy Policy, are the entire agreement between you and Learnest regarding the Service.
